This website is operated by Marsh's Embroidery. Throughout the site, the terms “we”, “us” and “our” refer to Marsh's Embroidery. Marsh's Embroidery offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service.
1. Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
2. Intellectual Property Rights & Customer Artwork Liability (Ironclad Protection)
Marsh's Embroidery executes custom embroidery designs based on images, logos, graphics, and text uploaded directly by our customers.

Customer Warranty: By uploading, submitting, or emailing any design, photograph, logo, trademark, or text to Marsh's Embroidery, you explicitly warrant and represent that you are the sole legal owner of that artwork, or that you possess explicit, written, and legal authorization from the copyright/trademark owner to replicate the design for commercial production.

Indemnification Shield: Marsh's Embroidery assumes absolutely no liability for trademark or copyright infringements resulting from customer-supplied imagery. If you upload a design that violates a third party's intellectual property rights (including but not limited to corporate logos, Disney/media characters, brand names, or protected artist illustrations), you agree to 100% defend, indemnify, and hold harmless Marsh's Embroidery, its owners, and employees against any and all legal claims, damages, demands, costs, fines, or attorney fees arising from such infringement.
3. Absolute Right to Refuse Service & Content Restrictions
We reserve the right to refuse service to anyone, for any reason, at any time, completely at our discretion. We retain the absolute right to review all customer-uploaded graphics and text. We will immediately cancel and refund any order containing imagery or text that we deem, at our sole discretion, to be offensive, defamatory, threatening, unlawful, profane, or promotional of hate speech and violence.
4. Production Turnaround Times & Variations
Because machine embroidery is a mechanical manufacturing process, timelines can fluctuate based on volume and complexity.

Production Estimates: While our internal facility goal is to complete and dispatch orders within 5 business days, our formal production timeline estimates are 7 to 14 business days for Custom Items, and up to 7 business days for Ready-to-Ship/Artist Items. These are strictly estimates and do not constitute legally binding delivery guarantees. Marsh's Embroidery is not liable for structural delays caused by postal carriers.

Screen Pixels vs. Thread Color Disclaimer: Digital screens display colors utilizing light (RGB pixels), whereas embroidery utilizes physical rayon or polyester threads. We cannot guarantee that the physical thread colors on your finished item will identically match the color profile displayed on your monitor or phone screen. Minor shade variations are a normal technical reality of the textile industry.

Physical Alignment Variations: Because custom garments and tote bags must be individually hooped by hand, micro-variations in final graphic placement, stitch direction, or slight fabric pulling are natural characteristics of custom garment embellishment and are not considered defects.
5. Ownership of the Digitized Embroidery File
When you purchase a custom embroidered product from Marsh's Embroidery, any "digitizing fee" or setup fee charged covers the skilled labor, specialized software configuration, and test-sewing required to convert your flat flat flat graphic into a machine-readable format.

Asset Retention: The resulting machine embroidery file (including but not limited to
.pes,.dst, or.jefformats) remains the exclusive, sole intellectual property of Marsh's Embroidery. -
Your payment grants you the right to purchase the physical, finished embroidered good. It does not grant you ownership of, or access to, the digital source-code file, and Marsh's Embroidery will not email or transfer native machine files to customers for external use.
6. Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
7. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Arizona and the United States of America, with legal jurisdiction strictly held in Peoria, Arizona.
